1. Subject of the contract
Sugar Sweet Kitchen (hereinafter referred to as SSK) sells the goods specified in the online shop or in written offers to business/private customers (hereinafter referred to as "customer") under the delivery and sales conditions (GTC) listed below.
2. Conclusion of contract
The contract between the customer and SSK is only concluded through an order from the customer and the acceptance of the order by SSK. The customer places the order by telephone, in writing or via the Internet. SSK accepts the order by (a) sending the customer an order confirmation (by fax, email or postal mail) or (b) delivering the ordered goods (incl. delivery note or invoice).
3. Product offering
All information about the goods that the customer receives as part of the ordering process is non-binding. In particular, changes in design and technology that improve the functionality of a product, as well as errors in description, illustration and price information, are reserved. All technical and content-related information about the individual goods is based on the manufacturer's specifications and is binding within this framework.
4. Payment terms
All catalogue prices are guide prices that are continuously adjusted to the market. They are in Swiss francs (Fr.), include VAT, are unpackaged, carriage unpaid from the Münsingen warehouse. Transport and packaging costs are charged separately. Payment must generally be made net in advance. Paypal, advance payment (Post&Bank) or Twint are accepted. The goods can also be paid for in cash when they are picked up.
5. Delivery terms
Ordered products can only be shipped to an address in Switzerland. If in stock, the products will be delivered immediately to the address specified by the customer. Otherwise, a written order confirmation with the expected delivery date will be issued. The delivery of the goods takes place (from the loading ramp) at the expense and risk of the customer, even if partial deliveries are made. Damage compensation will only be made for externally visible damage to the ordered goods against a certificate from the respective carrier.
6. Retention of title
The delivered goods remain the property of SSK until full payment has been received.
7. Right of return
The customer has the right to withdraw from the contract within 7 working days without stating reasons and to return the goods. Please return the delivered items undamaged, functional, complete and in their original packaging. The right of return begins upon receipt of the goods by the customer. The customer also bears the costs of the return shipment. The right of return for care products and shrink-wrapped goods only applies if the original packaging is unopened. All promotions and discontinued products are generally excluded from the right of return. This also applies to items that have been specially procured or manufactured at the customer's request. If the customer has returned the goods on time and correctly, SSK will issue a credit note, refund or, if desired, a replacement delivery.
8. Warranty for defects and liability
Products will be replaced or repaired free of charge, provided that the defect is reported in writing by the customer within 14 working days of receipt of the goods. If a product can no longer be repaired or replaced, the customer will receive an equivalent successor product or a credit note will be issued. The warranty expires if changes or repairs are made to the goods without the written consent of SSK. As far as legally permissible, liability for damages is excluded. In particular, SSK is not liable for damages resulting from improper use or natural wear and tear, or for damages that did not occur to the delivery item itself (consequential damages).
9. Intellectual property
SSK reserves all rights for every design, every text, every graphic on its website. Copying or any other reproduction of the entire website or parts of this website is only permitted for the purpose of placing an order with SSK. The name Sugar Sweet Kitchen, all page headers, navigation bars, graphics and button icons are registered trademarks, trade names or trademarks of SSK. All other trademarks, product names or company names or logos cited on this website are the sole property of their respective owners. SSK retains ownership and copyright to illustrations, drawings, calculations and other documents. The customer requires the express written consent of SSK before passing them on to third parties.
10. Data protection
SSK assures that it will observe the provisions of the Swiss Data Protection Act and the relevant legal norms when collecting, processing and using personal data. The customer data collected during order processing will only be used for internal market research purposes. Data will only be passed on to third-party partner companies if absolutely necessary for proper service provision (order processing). The customer agrees to this use of his data. Furthermore, he has the right to view the data stored about him at any time upon request and to prohibit its use for internal market research purposes.
11. Place of jurisdiction and applicable law
These GTC and the contracts concluded on the basis of these GTC are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Münsingen/Konolfingen.
12. Final provisions
When selling the goods specified in the SSK online shop, only the GTC valid at the time of the respective contract conclusion apply. These terms and conditions also apply in particular if they should differ from those of the customer. Should individual provisions of these GTC be or become invalid, this shall not affect the legal validity of the remaining provisions. Furthermore, SSK reserves the right to change these General Terms and Conditions at any time.
