1. General Information

By participating in the Sugar Sweet Kitchen Community Cake Topper project, customers can submit their own hand-drawn or hand-painted designs. These will be produced as cake toppers and sold in the online shop.

2. Terms of Participation

All persons who submit their own, self-created design are eligible to participate.

For minors, the consent of a legal guardian is required.

3. Design Requirements

Only the following are permitted:

  • own hand-drawn or hand-painted motifs
  • clear, printable representations
  • no digital copies or third-party templates

Specifically, the following are not allowed:

  • brands, logos, or protected characters (e.g., Disney, Pokémon, Marvel, etc.)
  • third-party content without rights
  • discriminatory or inappropriate content

Sugar Sweet Kitchen reserves the right to reject designs without stating reasons.

4. Rights of Use (License)

By uploading a design, the creator grants Sugar Sweet Kitchen a simple, non-exclusive right of use.

This includes, in particular:

  • the production of cake toppers
  • sale in the online shop
  • use for marketing and social media
  • display within the community category

The creator remains the owner of the design at all times.

5. Design Duration

Designs are offered within a staggered publication model.

5.1 Minimum Duration

Each design will be offered in the online shop for at least 7 days and can be ordered during this period.

5.2 Extension

After the minimum duration has expired, Sugar Sweet Kitchen may extend the duration by another 7 days, especially in case of high demand or good sales figures.

5.3 End of Publication

A design will be removed from the shop as soon as Sugar Sweet Kitchen decides that it is no longer actively sold or the sales phase has concluded.

6. Remuneration

The creator receives remuneration for each product sold with their design of:

CHF 5.– per cake topper sold

Alternatively, the creator can receive the remuneration in the form of a voucher of the same value (CHF 5.– per sale).

6.1 Billing and Payout

Remuneration will only be settled after the complete end of the publication of the respective design.

This means:

  • as soon as the design is no longer displayed and sold in the online shop (including any extensions),
  • the final settlement of all sales of this design will take place.

The payout or credit will be collected after the end of the sales phase as:

  • bank transfer or
  • shop voucher (depending on the creator's choice)

7. Processing of Designs

Sugar Sweet Kitchen is entitled to technically adapt the submitted designs, in particular:

  • adaptation for printing
  • background cleanup
  • optimization of colors and contrasts
  • cropping to the print format

The original motif remains unchanged in content.

8. Liability

The creator confirms that they own all rights to the submitted design and do not infringe on any third-party rights.

The submitter is liable for legal infringements.

9. Rights of Minor Participants

For participants under 18 years of age, the legal guardians confirm the submission and the transfer of rights of use.

10. Rejection & Removal

Sugar Sweet Kitchen reserves the right to reject designs or remove them from the shop at any time, especially in case of legal concerns, quality problems, or lack of demand.

11. Final Provisions

By uploading a design, the participant fully accepts these conditions.
